The Red Queen’s Race

I didn’t get any amendments this week. I held an appeal conference with my supervisor and another primary examiner, who agreed that we could go to the Board, so I wrote an Examiner’s Answer to an Appeal Brief on my amended docket, and now I’m down to one amendment; I’m hoping to hear back from the attorney about that one.

I finished a first Office Action on a Regular New application. Also, someone had filed a pre-Appeal Brief request for a conference, so I also met with my supervisor and the third party about that, and my supervisor filled out a form, which I signed, saying that we weren’t persuaded, and would go to the Board of Appeals if the applicant filed an actual Appeal Brief. The case remains on my Rejected docket; filing a request for a pre-Brief conference doesn’t move a case to the Amended docket.
